Please read these Terms of Service ("Terms", "Terms of Service") carefully before using BVDash Project Management Information System (the "Service") provided by BirdView Insight Inc/BVDash ("us", "we", "our" or “Vendor”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users and others who access or use the Service and are a legally binding contract between the Customer (“you”) and us. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
The Service is provided by us and accepted by the Customer "as is". Liability of the Vendor will be limited to a maximum of the subscription cost paid by the customer for the current month. BirdView Insight will not be liable for any general, special, incidental or consequential damages including, but not limited to, loss of production, loss of profits, loss of revenue, loss of data, or any other business or economic disadvantage suffered by the Customer arising out of the use or failure to use the Service.
Our Service allows you to post, store, share and otherwise make available certain project information, text, graphics, videos, or other material ("Content"). You are responsible for the use within or outside your organization. BirdView Insight has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party application or project management software connected to BVDash. You further acknowledge and agree that BirdView Insight Inc. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content or services available on or through any such systems or services.
All copyright, intellectual property rights and distribution rights of BVDash remain exclusively with BirdView Insight. Intellectual property rights include the look and feel of BVDash. This Agreement constitutes a license for use only and is not in any way a transfer of ownership rights to the Software.
We will make reasonable efforts to promptly solve system issues that may impact its functionality or performance, or may interfere the access to the system use or accessibility for limited periods of time; provided, that such conditions are reported so that Our technical team is able to reproduce the system issues, and you inform us of such faults in a timely manner. We may also perform other maintenance or System updates from time to time as needed. You shall not be entitled to any abatement in compensation for any System faults or downtime. We will make every effort possible to conduct such system maintenance off peak working hours whenever possible.
Support for BVDash Services is available at BVDash.com. Additional customer support may be available according with your service plan. Customer service is available by phone, email or LiveChat directly on our website.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least two weeks notice prior to any new terms taking effect.
You can cancel your services or close your BVDash account at any time. To close your account, please contact BVDash customer support by phone or email. If you close your account your access to BVDash system will stop at the end of your billing cycle. We will delete your Data or Your Content associated with your BVDash account upon your request. BVDash backup system may not be able to retrieve Your Content or Data once your account is closed. Clients who choose the monthly billing cycle will not be entitled to a partial or a full refund for cancelling in between their billing cycle. Discounted annual rates, special pre-paid promotions and additional or other discounted plans are not refundable, however (you) users will have access to the system until the end of billing term.
We may terminate or suspend access to our Service if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
The Terms are governed by the laws of the Province of British Columbia, Canada for the enforcement of the terms or any arbitration award or decision arising from the terms. The terms will been forced or construed according to the laws of the Province of British Columbia.
